Trump puts brakes on Biden-era AI regulation; future uncertain

As was expected, on day one of being inaugurated, President Donald Trump repealed outgoing President Joe Biden’s Executive Order (EO) that established comprehensive guidelines for the development and use of AI in the United States, including by federal agencies, once again raising concerns over unchecked privacy, ethics, and safety issues.
Late last month, for example, a required audit by the Department of Justice’s Inspector General found that the Federal Bureau of Investigation and Drug Enforcement Administration’s integration of AI is fraught with ethical dilemmas, regulatory inadequacies, and potential impacts on individual liberties.
The rescission of Biden’s Executive Order marks a pivotal moment in the evolution of AI policy in the U.S. and has initiated a seismic shift in the federal government’s approach to artificial intelligence regulation. It signals the administration’s intent to bolster AI innovation in the U.S. and a move toward reduced regulation of AI, which is something Trump championed, as have Republican members of the new Republican-controlled Congress.
At the moment, it’s unclear how and when Trump will replace Biden’s policies for regulating AI, creating a vacuum of guidance for federal agencies. During his first term, Trump issued two executive orders on AI that established a set of principles for safe and trustworthy government use of the technology and boosted funding for research and development.
While the move promises to accelerate innovation by reducing regulatory constraints, it raises significant concerns about ethical oversight, accountability, and the nation’s ability to address the societal impacts of AI. Biden’s order, which he signed on October 30, 2023, aimed to promote competition in the AI industry, prevent AI-enabled threats to civil liberties and national security, and to ensure U.S. global competitiveness in the AI field. Without a dedicated institution to monitor AI’s impacts, the government may struggle to respond effectively to emerging risks, such as the use of AI in cyberattacks or the erosion of privacy due to mass data collection.
The deregulatory stance adopted by Trump’s administration is not without merit. Proponents argue that by removing bureaucratic hurdles, the U.S. can maintain its leadership in AI innovation, particularly in the face of fierce competition from countries like China. A more agile regulatory environment may enable American companies to develop and deploy cutting-edge AI technologies more quickly, potentially securing economic and strategic advantages.
The debate over AI regulation also reflects deeper philosophical differences about the role of government in technological progress. Biden’s executive order embodied a precautionary approach, emphasizing the need to anticipate and mitigate risks before they manifest. Trump’s repeal of Biden’s EO, on the other hand, aligns with a more laissez-faire philosophy, prioritizing innovation and market dynamics over preemptive regulation.
